These Terms & Conditions (“Terms”) govern your access to and use of the Baby Bracket mobile application and related services (“Baby Bracket,” the “app,” or the “service”).

By creating an account or using Baby Bracket, you agree to these Terms. If you do not agree to these Terms, do not use the service.

Eligibility

Baby Bracket is intended for adults. You must be at least 18 years old, or the age of legal majority where you live, to create an account. By creating an account, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

The Baby Bracket Service

Baby Bracket is designed as a family and social prediction game. Users may create private brackets centered around a child, invite family members and friends to participate, make predictions about milestones, record actual results, earn points, and view leaderboard results.

Baby Bracket is provided for personal, recreational use. Features may be added, changed, suspended, or discontinued as the service develops.

Your Account

You are responsible for providing accurate account information and for maintaining the security of your account credentials. You are responsible for activity occurring through your account.

You may not impersonate another person, create an account using information you are not authorized to use, or allow another person to access the service through your account in a manner that violates these Terms.

Bracket Organizers

A user who creates or manages a bracket may enter information about a child, invite participants, manage bracket membership, create or manage milestones, and record actual milestone results.

If you create or manage a bracket, you are responsible for ensuring that you have the right and any necessary permission to provide information and photographs relating to the child and to share that information with the people you invite to the bracket.

Invitations and Private Groups

Baby Bracket is designed around private groups of invited participants. If you invite another person to a bracket, information within that bracket may become visible to that person after they join. You are responsible for choosing whom you invite and should only invite people with whom you are comfortable sharing the information contained in the bracket.

Your Content

You retain ownership of photographs, names, predictions, milestone information, and other content that you provide through Baby Bracket (“User Content”).

By providing User Content through Baby Bracket, you grant us a limited, non-exclusive license to host, store, process, reproduce, and display that content solely as reasonably necessary to operate and provide the service.

You represent that you have the rights and permissions necessary to provide your User Content and to permit Baby Bracket to use it as described in these Terms and our Privacy Policy.

Acceptable Use

You agree not to use Baby Bracket to:

• Violate any applicable law or regulation.
• Harass, threaten, abuse, or impersonate another person.
• Upload or share content that you do not have the right to use or share.
• Upload unlawful, harmful, fraudulent, defamatory, obscene, or otherwise inappropriate content.
• Attempt to gain unauthorized access to another account, bracket, system, or network.
• Interfere with or disrupt the operation or security of Baby Bracket.
• Introduce malicious code, viruses, or other harmful technology.
• Use automated systems to access, scrape, extract, or interfere with the service without authorization.
• Use Baby Bracket for unlawful commercial, gambling, wagering, or betting activities.

Predictions, Scores, and Results

Predictions, scores, rankings, and leaderboard results are provided as part of the recreational Baby Bracket experience.

Actual milestone information is generally entered by a bracket organizer. Baby Bracket does not independently verify the accuracy of information entered by users and is not responsible for disagreements among participants concerning predictions, milestone results, scoring, or bracket administration.

No Gambling or Wagering

Baby Bracket is a recreational prediction game and is not a gambling or wagering service. Baby Bracket does not provide, facilitate, administer, or collect wagers, entry fees, stakes, prizes, or payouts based on prediction results. Users may not use the service to conduct unlawful gambling, betting, or wagering activities.

Children

Baby Bracket is intended for adult account holders and is not directed to children under 13. Children do not need to create accounts in order for an adult organizer to create a bracket concerning them. Adults who provide information or photographs relating to a child are responsible for having the authority and any necessary permission to do so.

Privacy

Our collection and use of personal information is described in the Baby Bracket Privacy Policy. By using Baby Bracket, you acknowledge that information will be handled as described in that policy.

Baby Bracket Intellectual Property

Baby Bracket, including its name, branding, logos, visual design, software, graphics, interfaces, and original content provided as part of the service, is owned by Baby Bracket or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the service under these Terms, no rights in Baby Bracket intellectual property are transferred to you.

Third-Party Services

Baby Bracket relies on third-party technology and service providers to operate certain features, including account authentication, data storage, and related infrastructure. We are not responsible for interruptions, failures, or other issues caused by third-party services that are outside our reasonable control.

Service Availability

We aim to keep Baby Bracket available and functioning reliably, but we do not guarantee that the service will always be available, uninterrupted, secure, or error-free. The service may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, updates, or circumstances beyond our control.

Account Suspension and Termination

You may stop using Baby Bracket at any time and may delete your account using the account controls available in the app.

We may restrict, suspend, or terminate access to Baby Bracket if we reasonably believe that an account is being used in violation of these Terms, applicable law, the rights of another person, or in a manner that threatens the security or operation of the service.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Baby Bracket is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, that all information provided by users will be accurate, or that defects will always be corrected.

Limitation of Liability

To the fullest extent permitted by applicable law, Baby Bracket and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or relating to your use of or inability to use Baby Bracket. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Baby Bracket and its owners, operators, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, your misuse of the service, or User Content that you provide through Baby Bracket.

Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles, except to the extent that applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time as Baby Bracket evolves or as legal requirements change. When we make changes, we will update the effective date shown at the top of these Terms. Material changes may also be communicated through the app or by another appropriate method. Your continued use of Baby Bracket after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Entire Agreement

These Terms, together with the Baby Bracket Privacy Policy and any additional terms presented within the service, constitute the agreement between you and Baby Bracket regarding your use of the service.
